You may click the link to switch the active language.<\/p><p>Raportul Misiunii de observare (MO) Promo-LEX reflect\u0103 constat\u0103rile cu caracter electoral raportate de c\u0103tre observatori \u00een perioada 12- 25 mai 2021.<\/p>\n<p>Principalele aspecte reflectate \u00een raport \u021bin de:<\/p>\n<p><strong>Tendin\u021bele perpetuate \u00een desf\u0103\u0219urarea campaniei electorale<\/strong><\/p>\n<p>P\u00e2n\u0103 \u00een data de 26 mai 2021 CEC a \u00eenregistrat opt concuren\u021bi (\u0219ase partide \u0219i dou\u0103 blocuri electorale), iar alte dou\u0103 dosare sunt \u00een examinare. Cota minim\u0103 de reprezentare pentru ambele sexe (40%) a fost respectat\u0103 de c\u0103tre to\u021bi candida\u021bii. De asemenea men\u021bion\u0103m c\u0103, \u00een toate cele opt cazuri, pozi\u021bionarea candida\u021bilor pe liste a fost f\u0103cut\u0103 cu respectarea prevederilor legale, minimum patru candida\u021bi la fiecare zece locuri. \u00cen acela\u0219i timp, MO Promo-LEX a constatat c\u0103, majoritatea concuren\u021bilor au \u00eenceput activit\u0103\u021bile de agita\u021bie electoral\u0103 \u00een lipsa persoanelor de \u00eencredere \u00eenregistrate.<\/p>\n<p>Totodat\u0103, potrivit observatorilor Promo-LEX, unii (poten\u021biali) concuren\u021bi electorali au \u00eenceput agita\u021bia electoral\u0103 \u00eenainte de termenul legal stabilit. Astfel, au fost raportate cel pu\u021bin 15 activit\u0103\u021bi cu tent\u0103 electoral\u0103 (f\u0103r\u0103 \u00eendemn la vot) desf\u0103\u0219urate de concuren\u021bi\/poten\u021biali concuren\u021bi, precum \u0219i 18 cazuri de \u00eendemn la vot pentru un anumit concurent\/poten\u021bial concurent electoral (17 \u2013 Blocul electoral al Comuni\u0219tilor \u0219i Sociali\u0219tilor (BECS), 1 \u2013 Partidul Politic \u201eALIAN\u0162A PENTRU UNIREA ROM\u00c2NILOR (AUR).<\/p>\n<p><img loading=\"lazy\" class=\"alignnone size-medium wp-image-3417\" src=\"https:\/\/alegeliber.md\/wp-content\/uploads\/2021\/05\/Capture-146x200.png\" alt=\"\" width=\"146\" height=\"200\" srcset=\"https:\/\/alegeliber.md\/wp-content\/uploads\/2021\/05\/Capture-146x200.png 146w, https:\/\/alegeliber.md\/wp-content\/uploads\/2021\/05\/Capture-73x100.png 73w, https:\/\/alegeliber.md\/wp-content\/uploads\/2021\/05\/Capture.png 607w\" sizes=\"(max-width: 146px) 100vw, 146px\" \/><\/p>\n<p>Din momentul \u00eenregistr\u0103rii oficiale \u00een cursa electoral\u0103, \u00een perioada 21 \u2013 25 mai 2021, au fost raportate 46 de activit\u0103\u021bi desf\u0103\u0219urate de patru concuren\u021bi electorali: PAS \u2013 80%, BECS \u2013 11%, Blocul electoral \u201eRENATO USAT\u00ceI\u201d(BERU) -7% \u0219i PP\u0218 -2%. Cele mai populare activit\u0103\u021bi au fost distribuirea materialelor electorale (63%) \u0219i \u00eent\u00e2lnirile cu aleg\u0103torii (28%).<\/p>\n<p>Observatorii Promo-LEX au raportat de asemenea, cel pu\u021bin 121 cazuri (BECS) ce pot fi calificate drept utilizare a resurselor administrative. Dintre acestea, 120 de cazuri \u021bin de implicarea angaja\u021bilor din sectorul public \u00een activit\u0103\u021bi de campanie electoral\u0103 \u0219i un caz de asumare a meritelor pentru servicii efectuate din bani publici.<\/p>\n<p>La fel, au fost raportate cel pu\u021bin trei cazuri ce pot fi calificate drept oferire de cadouri cu impact electoral (BECS \u2013 2, BERU \u2013 1), dar \u0219i un caz ce poate fi calificat drept implicare a Pre\u0219edintelui Republicii Moldova \u00een campania de sus\u021binere a unui concurent electoral (PAS).<\/p>\n<p><strong>\u00cenregistrarea prealabil\u0103 \u2013 instrument \u00een baza c\u0103ruia cet\u0103\u021benii pot influen\u021ba num\u0103rul \u0219i geografia amplas\u0103rii sec\u021biilor de votare<\/strong><\/p>\n<p>Atragem aten\u021bia asupra cre\u0219terii num\u0103rului de \u00eenregistr\u0103ri prealabile cu circa 40 000 comparativ cu alegerile preziden\u021biale din noiembrie 2020. Potrivit estim\u0103rilor Promo-LEX, pe perioada ultimelor dou\u0103 s\u0103pt\u0103m\u00e2ni, doar \u00een baza indicatorului legal privind num\u0103rul de \u00eenregistr\u0103ri prealabile, \u00een cazul a cel pu\u021bin 8 state s-a modificat num\u0103rul sec\u021biilor de votare.<\/p>\n<p>Astfel, \u00een urma estim\u0103rilor Promo-LEX, dac\u0103 lu\u0103m ca baz\u0103 de calcul 150 SV bugetate de CEC, cele mai multe sec\u021bii urmeaz\u0103 a fi constituite \u00een Italia (28), Federa\u021bia Rus\u0103 (21), Germania (13), Marea Britanie (11), Fran\u021ba (9) \u0219i Rom\u00e2nia (9).<\/p>\n<p>De asemenea, av\u00e2nd drept baz\u0103 de calcul 191 SV propuse de MAEIE, cele mai multe SV urmeaz\u0103 a fi constituite \u00een Italia (37), Federa\u021bia Rus\u0103 (29), Germania (17), Marea Britanie (16), Fran\u021ba (12) \u0219i Rom\u00e2nia (11).<\/p>\n<p><strong>Concuren\u021bii electorali pot cheltui la alegerile parlamentare anticipate de 4 ori mai putini bani, comparativ cu scrutinul parlamentar din 2019<\/strong><\/p>\n<p>\u00cen perioada de referin\u021b\u0103, CEC a stabilit un plafon general al mijloacelor financiare ce pot fi transferate pe contul \u201eFond electoral\u201d al concurentului electoral \u0219i al grupului de ini\u021biativ\u0103 \u00een m\u0103rime de 20 707 700 lei, de circa patru ori mai pu\u021bin dec\u00e2t pentru alegerile parlamentare din 2019 (86 871 856 lei). Diferen\u021ba considerabil\u0103 a valorilor maxime stabilite \u00een 2019 \u0219i 2021 se datoreaz\u0103 modific\u0103rii prevederilor Codului electoral (august 2019) \u0219i stabilirii unui plafon de 0,05% din veniturile prev\u0103zute \u00een legea bugetului de stat pentru anul respectiv<\/p>\n<p>Conform observatorilor Promo-LEX, p\u00e2n\u0103 la 25 mai 2021, pe pagina web a CEC nu a fost publicat nici un raport al partidelor politice care urmeaz\u0103 s\u0103 efectueze viramente \u00een contul \u201dFond electoral\u201d. \u00cen plus, informa\u021bia privind deschiderea contului \u201dFond electoral\u201d a fost prezentat\u0103 doar de PAS, termenul limit\u0103 pentru publicarea informa\u021biei fiind 26 mai 2021.<\/p>\n<p><strong><img loading=\"lazy\" class=\"alignnone size-medium wp-image-3418\" src=\"https:\/\/alegeliber.md\/wp-content\/uploads\/2021\/05\/IMG_6475-2-1-768x500-200x130.jpg\" alt=\"\" width=\"200\" height=\"130\" srcset=\"https:\/\/alegeliber.md\/wp-content\/uploads\/2021\/05\/IMG_6475-2-1-768x500-200x130.jpg 200w, https:\/\/alegeliber.md\/wp-content\/uploads\/2021\/05\/IMG_6475-2-1-768x500-100x65.jpg 100w, https:\/\/alegeliber.md\/wp-content\/uploads\/2021\/05\/IMG_6475-2-1-768x500.jpg 768w\" sizes=\"(max-width: 200px) 100vw, 200px\" \/><\/strong><\/p>\n<p><strong>Riscuri privind buna organizare \u0219i desf\u0103\u0219urare a scrutinului<\/strong><\/p>\n<p>MO Promo-LEX atrage aten\u021bia asupra unor incertitudini privind constitu\u021bionalitatea art. 51 alin. (4) Cod electoral. Aceasta se refer\u0103 la interdic\u021bia de atragere la r\u0103spundere a candida\u021bilor sau supunerea unor sanc\u021biuni pe perioada electoral\u0103, f\u0103r\u0103 consim\u021b\u0103m\u00e2ntul organului electoral care i-a \u00eenregistrat. Pornind de la faptul c\u0103 o norm\u0103 cu exact aceea\u0219i form\u0103 \u0219i con\u021binut ca prevederea de la art. 51 alin. (4) Cod electoral, a fost declarat\u0103 anterior neconstitu\u021bional\u0103, MO Promo-LEX consider\u0103 c\u0103 aceasta nu trebuie \u0219i nu poate fi aplicat\u0103 de autorit\u0103\u021bi, iar concuren\u021bii electorali nu se pot prevala de aceste garan\u021bii.<\/p>\n<p>De asemenea, MO Promo-LEX remarc\u0103 faptul c\u0103 \u00een plin proces de organizare a alegerilor \u0219i \u00een condi\u021biile demar\u0103rii activit\u0103\u021bilor de agita\u021bie electoral\u0103, \u00eenc\u0103 nu exist\u0103 o reglementar\u0103 clar\u0103 a m\u0103surilor de prevenire \u0219i control al infec\u021biei COVID-19 \u00een context electoral. \u00cen lipsa unor astfel de m\u0103suri, exist\u0103 riscul c\u0103 ar putea cre\u0219te rata de contaminare cu infec\u021bia COVID-19.<\/p>\n<p>\u00cen continuare, constat\u0103m lipsa unei hot\u0103r\u00e2ri de Guvern care ar asigura acoperirea deplin\u0103 a cheltuielilor aferente organiz\u0103rii alegerilor parlamentare anticipate. Reiter\u0103m \u00eengrijorarea privind starea de incertitudine existent\u0103 cu privire la capacitatea autorit\u0103\u021bilor publice centrale de a identifica resurse financiare suficiente pentru buna desf\u0103\u0219urare a scrutinului.<\/p>\n<p>\u00cen perioada monitorizat\u0103 Comisia Electoral\u0103 Central\u0103 a aprobat 63 de hot\u0103r\u00e2ri, printre care un regulament, iar alte dou\u0103 au fost ajustate la normele legale specifice sistemului propor\u021bional. \u00cen acela\u0219i timp, potrivit Promo-LEX, cel pu\u021bin \u00eenc\u0103 cinci regulamente CEC necesit\u0103 a fi adaptate la modific\u0103rile Codului electoral.<\/p>\n<p>Constat\u0103m \u0219i la acest scrutin ignorarea de c\u0103tre APL a competen\u021belor pe care le de\u021bin cu privire la desemnarea membrilor \u00een organele electorale. Astfel, MO Promo-LEX a identificat cel pu\u021bin \u0219apte CECE II (19%) \u00een care niciun membru nu a fost desemnat de c\u0103tre APL de nivelul II.<\/p>\n<p><strong>\u00cenc\u0103 un scrutin marcat de cazuri de incitare la ur\u0103 \u0219i discriminare<\/strong><\/p>\n<p>\u00cen baza informa\u021biilor raportate de c\u0103tre monitori, \u00een perioada 11-24 mai 2021, au fost identificate cel pu\u021bin 23 de cazuri de discurs de ur\u0103 \u0219i instigare la discriminare \u00een spa\u021biul public, \u00een mass-media \u0219i \u00een mediul online din Republica Moldova.<\/p>\n<p>Astfel, \u0219ase concuren\u021bi electorali\/politicieni au utilizat forme intolerante de exprimare: Renato Usat\u00eei (BERU) \u2013 cinci cazuri \u0219i Vladimir Voronin (BECS), Octavian \u021a(BE (PUN), Vasile Bolea (BECS) \u0219i Vladimir Odnostalco (BECS) \u2013 c\u00e2te un caz.<\/p>\n<p>Din cele 23 de cazuri de discurs de ur\u0103 sau instigare la discriminare identificate, \u00een 9 cazuri au fost viza\u021bi concuren\u021bi\/poten\u021biali concuren\u021bi\/politicieni: Vladimir Voronin (BECS) \u2013 2 cazuri, Maia Sandu (Pre\u0219edinte Republica Moldova) \u2013 2 cazuri, Natalia Albot (activist\u0103 \u0219i jurnalist\u0103 \u00eenaintat\u0103 pe lista PAS \u0219i care s-a retras pe data de 21.05.2021 \/ 2 cazuri), Igor Dodon (BECS), Dumitru Diacov (PDM) \u0219i Vasile Bolea (BECS) \u2013 c\u00e2te un caz.<\/p>\n<p>Raportul MO Promo-LEX poate fi accesat aici: <a href=\"https:\/\/promolex.md\/20327-raportul-nr-2-misiunea-de-observare-a-alegerilor-parlamentare-anticipate-din-11-iulie-2021\/?lang=ro\">https:\/\/promolex.md\/20327-raportul-nr-2-misiunea-de-observare-a-alegerilor-parlamentare-anticipate-din-11-iulie-2021\/?lang=ro<\/a><\/p>","protected":false},"excerpt":{"rendered":"<p>\u041d\u0435 \u043d\u0430\u0439\u0434\u0435\u043d\u043d\u043e For the sake of viewer convenience, the content is shown below in the alternative language.
